Terms of Use
Last updated October 25, 2026
These Terms of Use ("Terms") are a binding agreement between you and Humm ("Humm", "we", "us" or "our") governing your use of the Humm mobile app, the website at eathumm.com, and related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.
Please read Section 15 carefully. It contains a binding arbitration agreement and class action waiver that affect how disputes between you and Humm are resolved. You may opt out as described there.
1. What Humm is
Humm is a discovery service: a directory that helps you find independent home cooks and links you to their own channels, such as Instagram, TikTok or Facebook. Humm does not prepare, sell, handle, package, deliver or inspect food, does not take orders, and does not process payments. Any order, payment, pickup, refund or other arrangement is made directly between you and the cook, on the cook's own channels and terms. Humm is not a party to those transactions.
Cooks listed on Humm ("Cooks") are independent third parties. They are not Humm's employees, agents, contractors or partners, and Humm does not control their food, kitchens, prices, availability or conduct.
2. Food safety and your responsibility
Food from home kitchens may not be inspected, licensed or permitted by a health authority, and may not be prepared under the same conditions as food from a licensed food business. Food may contain or come into contact with allergens, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy and sesame.
- You are solely responsible for deciding whether to buy and eat food from any Cook. Ask the Cook about ingredients, allergens, preparation and storage before ordering.
- Follow safe handling practices: refrigerate perishable food promptly and reheat it thoroughly.
- If you believe you became ill from food, seek medical care, contact the Cook and your local health department, and let us know at hello@eathumm.com.
A "Verified" badge means only that our team reviewed the Cook's public channels and believed, at that time, that the Cook was a real person actively offering food. It is not a certification, endorsement, inspection, license check, or guarantee of food safety, quality, legality or the Cook's conduct.
3. Eligibility and accounts
You must be at least 13 years old to use the Services, and at least 18 (or the age of majority where you live) to arrange purchases from Cooks. You agree to give accurate information, keep your sign-in methods secure, and are responsible for activity on your account. You may delete your account at any time in the app (Profile › Delete account).
4. Your content
"Your Content" means reviews, photos, cook suggestions, reports and anything else you submit. You are responsible for Your Content and confirm that you have the rights to it and that it complies with these Terms. Reviews must reflect your own genuine experience; don't post reviews in exchange for payment, about your own business, or on behalf of someone else.
You keep ownership of Your Content. You grant Humm a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, modify (for example, to resize or crop), publish, display and distribute Your Content in connection with operating, promoting and improving the Services, including in the app, on eathumm.com and in marketing for Humm. This license ends when you delete Your Content or your account, except for copies already shared or held in backups for a limited time, or where we must keep it by law.
We may, but have no obligation to, review, edit or remove any content, and we may remove content or restrict accounts at our discretion, including content we believe violates these Terms or the law.
5. Acceptable use
You agree not to:
- post anything unlawful, defamatory, fraudulent, hateful, harassing, threatening, sexually explicit, or that infringes anyone's rights or privacy (including others' personal information);
- post false or misleading reviews or manipulate ratings;
- impersonate anyone or misrepresent your affiliation;
- use the Services to offer or arrange anything illegal;
- scrape, crawl, copy or harvest data from the Services, or use them to build a competing product;
- interfere with, disrupt, reverse engineer or attempt to gain unauthorized access to the Services or their systems;
- use bots or automated means to access the Services, except as we expressly allow.
6. Reporting, blocking and moderation
You can report a Cook or review, and block other users, in the app. We review reports and act on objectionable content, which may include removal and account suspension. We have no tolerance for objectionable content or abusive users.
7. Suggesting and listing Cooks
You may suggest a Cook only if they publicly offer food. We review every suggestion and may decline, edit or remove any listing at any time for any reason. Listings may include information the Cook has made public, such as their name, photos of their food, city and social media handles.
Cooks. If you are a Cook listed on Humm, you are solely responsible for complying with all laws that apply to your food and business, including food safety, permitting and licensing (such as cottage food rules and local health codes), labeling and allergen disclosure, taxes and business registration. You confirm that the information and photos associated with your listing are accurate and that you have the rights to them. You may ask us to correct or remove your listing at any time at hello@eathumm.com, and we will do so promptly.
8. Third-party services
The Services link to and rely on third-party services, including Cooks' social media accounts, Instagram, TikTok, Facebook, Apple and Google. We don't control and aren't responsible for third-party services, their content or their terms and privacy practices. Your use of them is at your own risk and subject to their terms.
9. Our intellectual property
The Services, including the Humm name, logo, design, software and content we create, are owned by Humm or its licensors and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use, in accordance with these Terms. If you send us feedback or ideas, we may use them without obligation to you.
10. Copyright complaints
If you believe content on Humm infringes your copyright, email hello@eathumm.com with: your contact information; a description of the work; where the content appears on Humm; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the owner; and your physical or electronic signature. We will remove infringing content and may terminate repeat infringers.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HUMM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. HUMM MAKES NO REPRESENTATION OR WARRANTY ABOUT ANY COOK OR FOOD, INCLUDING ITS SAFETY, QUALITY, INGREDIENTS, ALLERGENS, LEGALITY, PERMITTING OR FITNESS FOR CONSUMPTION, OR ABOUT THE ACCURACY OF LISTINGS, PHOTOS, AVAILABILITY OR REVIEWS. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
12. Release
Because Humm is not involved in transactions between you and Cooks, you release Humm and its owners, employees and agents from any claims, demands and damages of every kind, known and unknown, arising out of or in any way connected with any dispute you have with a Cook or other user, including claims for illness, injury or property loss related to food. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Nothing here limits liability that cannot be limited by law.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HUMM AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, OR FOR ANY PERSONAL INJURY, ILLNESS OR PROPERTY DAMAGE ARISING FROM FOOD OR FROM YOUR DEALINGS WITH COOKS OR OTHER USERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HUMM'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF $50 OR THE AMOUNT YOU PAID HUMM IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DON'T ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
14. Indemnity
You agree to defend, indemnify and hold harmless Humm and its owners, employees and agents from any claims, losses, liabilities, damages and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Services, your violation of these Terms or of law, or, if you are a Cook, your food, products and business.
15. Dispute resolution: arbitration and class action waiver
Informal resolution first. Before bringing a claim, you agree to email hello@eathumm.com describing the dispute and give us 60 days to try to resolve it informally.
Binding arbitration. Except as described below, any dispute arising out of or relating to these Terms or the Services will be resolved by final, binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitration may take place by video or phone, or in the county where you live. Payment of filing and arbitrator fees will be governed by the AAA's rules.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for misuse of intellectual property.
Class action waiver. You and Humm may bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate claims or preside over a representative proceeding.
Opt out. You may opt out of this Section 15 by emailing hello@eathumm.com within 30 days of first accepting these Terms, with your name, the email on your account and a statement that you opt out of arbitration.
If the class action waiver is found unenforceable for a claim, that claim will proceed in court, not arbitration.
16. Termination
You may stop using the Services at any time. We may suspend or end your access at any time, including if you violate these Terms. Sections that by their nature should survive (including 4, 9 and 11 through 18) survive termination.
17. Apple App Store
If you downloaded the app from Apple's App Store: these Terms are between you and Humm only, not Apple, and Humm (not Apple) is responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. General
Governing law. These Terms are governed by the laws of the State of Washington and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 15, the state and federal courts located in King County, Washington have exclusive jurisdiction.
Changes. We may update these Terms. We'll post the new version with a new "Last updated" date and, for material changes, notify you in the app or by email. Continuing to use the Services after changes take effect means you accept them.
Other terms. These Terms and the Privacy Policy are the entire agreement between you and Humm about the Services. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them, for example in a merger or sale. We are not liable for delays or failures caused by events beyond our reasonable control.
